WEBSITE TERMS AND CONDITIONS

These Website Terms and Conditions ("Terms") govern access to and use of the website located at www.masonhomemanagement.com or www.mhmstl.com (the "Site"), operated by Mason Home Management LLC ("MHM," "we," "us," or "our"), a Missouri limited liability company. By accessing or using the Site after these Terms are made conspicuously available, you agree to them to the extent enforceable under applicable law. If the Site presents an acceptance checkbox, button, or similar electronic process, selecting it constitutes your electronic signature and affirmative acceptance. If you do not agree, do not use the Site.
The Site provides general information about MHM and private home management services in the St. Louis metropolitan area. Site content is not an offer, binding quote, professional inspection, construction advice, engineering advice, insurance advice, legal advice, or guarantee of service availability or results.
Submitting an inquiry does not create a service relationship. MHM provides home management services only after accepting an engagement under a separately executed Private Home Management Agreement. If these Terms or Site content conflicts with a signed service agreement concerning paid services, the signed service agreement controls.
The Site is intended for persons at least eighteen years old who may lawfully agree to these Terms. A person using the Site for an entity represents that the person has authority to bind that entity.
You may provide only accurate information that you are authorized to disclose. Do not submit passwords, alarm codes, payment card security codes, complete bank information, Social Security numbers, or other unnecessary sensitive information through a general Site form. A submission grants MHM permission to use it to respond to the request, evaluate services, protect the Site, and otherwise act as described in the Privacy Policy.
When you provide contact information, you authorize MHM to respond about your inquiry or services by the methods you provide. Marketing calls or texts require any separate consent required by law, and consent to marketing is not a condition of purchase. You may opt out of marketing communications using the instructions provided.
You shall not use the Site to violate law; infringe rights; submit false, harmful, or unlawful material; introduce malicious code; interfere with security or operation; gain unauthorized access; scrape or harvest information through automated means; impersonate another person; or use Site content to compete unfairly with or misrepresent MHM.
The Site, branding, text, graphics, photographs, layouts, checklists, and other content are owned by MHM or its licensors and protected by applicable intellectual property law. Subject to these Terms, MHM grants you a limited, revocable, nonexclusive, nontransferable license to view and print Site content for personal, noncommercial evaluation of MHM's services. No other use is permitted without written authorization.
If you voluntarily provide an idea or suggestion about the Site, you grant MHM a nonexclusive, worldwide, royalty-free license to use it without identifying you, but you do not transfer ownership of confidential property or service information merely by submitting an inquiry.
The Site may link to or use third-party services. Links are provided for convenience and do not constitute endorsement. MHM does not control and is not responsible for a third party's content, availability, security, terms, or privacy practices.
Our Privacy Policy and Cookie Policy explain our information and technology practices. They are incorporated for notice purposes. If a separate service agreement imposes greater confidentiality or security obligations, that agreement controls for the applicable client relationship.
MHM may change, suspend, or discontinue Site content or functionality. MHM does not promise that the Site will be available without interruption, secure, current, accurate, or free of errors or harmful components.
TO THE FULLEST EXTENT PERMITTED BY LAW, THE SITE AND ITS CONTENT ARE PROVIDED "AS IS" AND "AS AVAILABLE." MHM DISCLAIMS IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT. NOTHING DISCLAIMS A WARRANTY OR RIGHT THAT CANNOT LAWFULLY BE DISCLAIMED.
TO THE FULLEST EXTENT PERMITTED BY LAW, MHM AND ITS MEMBERS, PERSONNEL, AND SERVICE PROVIDERS SHALL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES ARISING FROM SITE USE. MHM'S TOTAL LIABILITY FOR A SITE-ONLY CLAIM SHALL NOT EXCEED ONE HUNDRED DOLLARS. LIABILITY RELATING TO PAID SERVICES IS GOVERNED BY THE APPLICABLE SIGNED SERVICE AGREEMENT. THESE LIMITATIONS DO NOT APPLY TO FRAUD, INTENTIONAL MISCONDUCT, GROSS NEGLIGENCE, OR LIABILITY THAT CANNOT BE LIMITED.
To the extent permitted by law, you shall indemnify and hold harmless MHM and its members and personnel from a third-party claim arising from your unlawful Site use, infringement by content you submit, or material breach of these Terms. This obligation does not apply to the extent a claim results from MHM's own negligence or misconduct.
Missouri law governs these Terms, without regard to conflicts principles, except where federal or another nonwaivable law applies. A dispute arising solely from the Site shall be brought in a state court of competent jurisdiction in St. Louis County, Missouri, or, if federal jurisdiction exists, the United States District Court serving that county. A signed service agreement governs disputes concerning paid services.
MHM may revise these Terms by posting an updated version and effective date. A change applies prospectively. If applicable law requires additional notice or consent, MHM will provide it.
If a provision is unenforceable, it shall be enforced to the maximum lawful extent and the remaining Terms remain effective. MHM's failure to enforce a provision is not a waiver. You may not assign these Terms without MHM's consent. These Terms, together with incorporated notices and any applicable signed service agreement, contain the entire agreement concerning Site use.
You consent to receive Site-related records and communications electronically at the contact information you provide, subject to any separate consent required by law. You may retain these Terms by printing or saving them. A service agreement, payment authorization, marketing consent, or other transaction requiring separate assent is effective only through the applicable acceptance process and is governed by its own terms.
